Bankruptcy Concerns? We Have Answers.

When you are considering bankruptcy, it is important to find a lawyer who will listen to your story, analyze your situation and create a debt relief plan tailored to your unique needs. At the Royal Oak and Flint offices of Bidwell Tovarez PLLC, we provide a professional and supportive environment where you can discuss your debt problems in confidence with one of our attorneys. We will answer your questions and evaluate all your options for relief.

Learn What To Expect In A Michigan Bankruptcy Case

There are a lot of factors to consider before finding the debt relief option that works best for you. We will make sure you understand all important bankruptcy terms and clear up any bankruptcy myths you may have heard, so you know exactly what to expect. We can also answer your questions, such as how bankruptcy impacts divorce and vice versa.

While we will consider all your options, most clients end up with one of the following plans:

  • Chapter 7: Also known as straight liquidation, Chapter 7 generally eliminates your unsecured debt. In most cases, you will not lose your home or other property. Only debtors who qualify according to a means test may file for Chapter 7.
  • Chapter 13: If you are not eligible for Chapter 7, need to save a home from foreclosure or have assets you may not be able to protect in Chapter 7, you may need to file Chapter 13. In a Chapter 13 case, we propose a plan to repay all or a portion of your debt over a three- to five-year period. Once approved by the court, you will make affordable payments to a trustee, who will then make payments to your creditors. Any remaining unsecured debt after the three- to five-year period will be eliminated.

Put A Stop To Creditor Harassment Right Now

By filing for either type of consumer bankruptcy, you will receive an automatic stay, which will immediately stop creditor harassment and help you protect your assets.
